Omisore Withdraws Case Challenging Osun APC Guber Primary

The campaign organisation of Iyiola Omisore has announced that the former senator has discontinued a lawsuit he filed against the All Progressives Congress (APC) over Disqualification of Some Governorship aspirants ahead of the party’s primary in Osun State.

This was disclosed in a statement issued in Osogbo on Thursday and signed by its Director-General, Ajibola Famurewa.

The statement explained that the suit, marked FHC/OS/CS/261/2025 – Senator Iyiola Omisore v. APC & ANR, was filed after seven out of eight aspirants were reportedly disqualified by the party’s screening panel.

The case was instituted to test the validity of the panel’s decision, which the organisation alleged violated provisions of the Electoral Act 2022.

It was gathered that the development follows reports that details of the suit filed by Omisore against the APC and the Independent National Electoral Commission (INEC) had resurfaced, raising concerns within the party as campaigns begin for the August 15 governorship election in the state.

In the originating summons dated December 9, 2025, Omisore had asked a Federal High Court sitting in Osogbo to determine whether the APC could impose qualification or disqualification criteria on aspirants beyond what is provided in the 1999 Constitution of Nigeria.

Omisore sought, among other reliefs, a declaration that the party could not validly disqualify him from contesting the governorship primary, having satisfied the constitutional requirements under Sections 177 and 182 of the constitution.

The originating summons further requested an order voiding and/or setting aside the purported disqualification of the plaintiff as an aspirant at the 1st defendant governorship primary election for the election of a governorship candidate to represent the 1st Defendant at the Osun State forthcoming Governorship Election, having failed to comply with the requirement for the nomination of candidate for election under Section 84 (2) & (3) of the Electoral Act 2022 (as amended).

Omisore also sought an order restraining INEC from recognising any primary election conducted by the APC to nominate a governorship candidate for the Osun election.

The suit, filed by his counsel, Kolawole Salami, before Justice Adefunmilola Demi-Ajayi, became public knowledge after a court log listing matters scheduled for March 2 surfaced on social media.

The case was listed as the 11th matter for the day.

The campaign organisation stated that the suit was later withdrawn following interventions by prominent party leaders, including President Bola Ahmed Tinubu and Chief Bisi Akande.

The organisation explained that upon the intervention of the President, Asiwaju Bola Ahmed Tinubu, Chief Bisi Akande and other well-meaning leaders that led to Senator Omisore’s engagement of the media on a national television to follow the party’s decision and to honour Mr President.

They accused some individuals of misrepresenting the situation to create panic within the party.

It urged APC members and the public to disregard reports suggesting that the suit was still pending, while calling for unity within the party ahead of the election.
